A Settlement has been reached in a class action lawsuit concerning PracticeMax, Inc. ("Defendant" or "PracticeMax") and a data security incident (the "Data Security Incident") that occurred in early 2021, when one or more unauthorized individuals accessed information on a database belonging to PracticeMax, including full names, Social Security numbers, financial account information and/or credit card information, dates of birth, prescription information, diagnosis information, treatment information, treatment providers, health insurance information, medical information, and Medicare/Medicaid ID numbers ("Private Information").
The lawsuit asserts claims related to the Data Security Incident. The Defendant in the lawsuit is PracticeMax, Inc. PracticeMax denies it is or can be held liable for the claims made in the lawsuit. The Settlement does not establish who is correct, but rather is a compromise to end the lawsuit.
Members of the Class are all individuals to whom PracticeMax sent notice of the Data Incident that occurred in early 2021. The Class specifically excludes:
- all Persons who timely and validly request exclusion from the Class;
- the judge assigned to evaluate the fairness of this Settlement (including any members of the Court's staff assigned to this case);
- Defendant's officers and directors; and
- any other Person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding, or abetting the criminal activity occurrence of the Data Security Incident or who pleads nolo contendere to any such charge.
